An orphanage is a place of residence, dedicated to the care of orphans and children separated from their natural families, or in simple terms, an orphanage is a place where those children are cared for who have no one in their lives.
According to a recent study by the international charity for orphaned and abandoned children, India currently has 29.6 million orphans, and this figure is expected to increase by 2021. Indian children are orphans and most of these children have been abandoned by their parents. In fact, it is estimated that only 0.3 percent of these orphans are children who have lost their parents.
As reported by Ipleaders, India is the second-most populous country in the world and is home to many orphans. As India struggles with poverty, hunger, and corruption, many children lose their parents or even their families. According to UNICEF, there were about 25 million orphans in India in 2007. With the onset of the Covid-19 pandemic in 2020, the number of orphans in India has grown exponentially. Therefore, it is important to examine the existing legal framework in India that aims to protect orphans.
In terms of Article 39 (f) of the Constitution of India, the state may make policies to ensure that children are provided with adequate opportunities and resources, essential for their development and to protect themselves from exploitation and abandonment. In many cases, only an orphanage can provide for orphans with basic needs such as food, shelter, clothing, and education until they are 14 years old. Therefore, the state is empowered to make laws to ensure that orphanages in the country are properly cared for and to receive adequate support to protect the rights of orphaned children. The existing legal rights of orphans are the Right to life, Right to health, Right to citizenship, protection from exploitation, and Right to education.

Mrs. Janish from Vatsalyapuram Orphanage NGO, Jayanagar, Bangalore. This is a children's orphanage for the past 2 years. It has several branches in India such as Rajasthan, Surat, Indore, etc. She talked about some of the basic necessities of the orphanage Children and her experience.

BOSCO - Bangalore Oniyavara Seva Coota - a non-profit organization, founded in 1980 by the Salesians of Don Bosco and registered in 1986 under the Society's Registration Act of 1960. BOSCO abbreviated as "Bangalore Oniyavara Seva Coota" which means, the organization of those who serve on the streets of Bangalore or literally, "the organization of those who serve the youth on the streets of Bangalore". They have rescued 37,950 children from the streets and restored 23,283 homeless children from the streets to their families from 2014 to 2020. It has also received the national award for child welfare.

Ranjitha works at BOSCO Mane, Chamrajpet, Bangalore. Mane - a home that prepares the put of schoolboys to rejoin school education. BOSCO Mane opened in 1986 as a home for boys prepared to join a school education through bridge courses. The center is a home-based center for young boys who are being urged to leave the streets. School enrollment and home placement for children are also done at the center. About 35 boys live in the center. She talked about the orphanage children.

According to the Reliefweb report, conditions causing to be orphans due to War, invasion, natural disasters, poverty, and the same problem is the root reason why children lose their parents, so orphans. Orphans need emotional support and physical support needs such as accommodation, food, health care, and education. Because of their circumstances as orphans, they have feelings of anxiety, depression, anger, and isolation.
According to research on orphans in Uganda, 12% of AIDS orphans are determined to die. Those orphans are sheltered by their relatives they must dwell in the dense homes and earn less when they try to help with household chores, care for siblings, and care for their patient parents. When orphaned children are without the protection of their families, trusted relatives, or institutions they face a variety of life-threatening situations and accidents. Human trafficking is abandoned, child soldier employment, child labor, organ mafia, missionaries, involvement in crime, and drug abuse exists among the threats they face.
Orphanage plays a very important role in our country. There is a lot of crime among children. They are victims of abuse, sexual and psychological violence, and, increasingly, child abuse in orphanages and homes is common. Many orphanages in India are poorly maintained, have good infrastructure, and children are not safe either. Also involved in child labor, child abuse, etc. However, despite that, there are real orphanage NGOs willing to help and support the children.
